These Terms and Conditions form a binding agreement between you and Sivibe regarding your access to and use of the Sivibe application, features, and related services. By downloading, installing, accessing, or using Sivibe, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the app. Your continued use of Sivibe after any update to these Terms also constitutes your acceptance of the revised version.
Sivibe may offer consumable virtual currency in the form of coins, which may be purchased through Apple In-App Purchase mechanisms. Coins may be used to access certain app actions, including generating shareable meal cards or archiving meal gathering records after any free-use opportunities are exhausted. The number of coins required for certain actions may vary, including randomized coin consumption ranges where disclosed in the app.
All coin purchases are final except where required by applicable law or Apple policy. Coins are licensed, not sold, have no cash value, are not redeemable for money or monetary equivalent, and may not be transferred, resold, or exchanged outside the app. Except as required by law, unused coins are non-refundable, including if you stop using the app or your access is terminated.
Sivibe is provided on an "as available" and "as is" basis. We do not guarantee that the app will always be available, uninterrupted, secure, current, or free from delays, defects, or errors. Features may vary by device, operating system, region, or platform rules.
We reserve the right, at any time and without liability, to modify, limit, suspend, discontinue, or remove any part of the service, whether temporarily or permanently, including app features, storage behavior, coin functionality, or compatibility requirements.
We may revise these Terms from time to time to reflect changes in the service, legal requirements, operational needs, or business practices. When we do, we may update the effective date shown above and make the revised Terms available within the app or by other reasonable means.
Your continued use of Sivibe after updated Terms become effective means you accept the revised Terms. If you do not agree to the changes, you must stop using the app.
We may suspend, restrict, or terminate your access to Sivibe at our discretion if we believe you have violated these Terms, created risk for the app, other users, or third parties, engaged in misuse, or if we are required to do so for legal or technical reasons.
You may stop using Sivibe at any time. Termination or discontinuation of access does not automatically entitle you to refunds, compensation, or restoration of any virtual currency, except where required by applicable law.
To the fullest extent permitted by law, Sivibe and all related features, content, and functionality are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory. This includes, without limitation, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and quiet enjoyment.
We do not warrant that the app will meet your requirements, that records will always be preserved, that generated summaries or reminders will be accurate, or that the app will operate without interruption or error.
You must be at least 17 years old to use Sivibe. By using the app, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into this agreement.
If you are using the app on behalf of another person or entity, you represent that you are authorized to bind that person or entity to these Terms.
Sivibe may organize, summarize, display, or generate meal-related records based on information you provide, including friend preference profiles, group preference lists, dish suggestion records, timeline entries, conflict notices, or shareable meal cards. These outputs are automated or user-assembled records intended only for convenience, personal organization, and informational reference.
We do not guarantee that any generated result is complete, accurate, current, suitable, or appropriate for any decision. The app does not provide medical, nutritional, allergy, treatment, or clinical advice and does not determine whether food is safe for any person. Any reliance on generated results is solely at your own risk, and you remain responsible for verifying all preferences, allergies, restrictions, locations, and meal decisions independently.
You agree not to misuse Sivibe. Prohibited conduct includes, without limitation: violating any law or regulation; infringing the rights of others; uploading malicious code; interfering with app security or stability; attempting to gain unauthorized access to data, systems, or accounts; scraping or harvesting information; using bots, scripts, or automated tools to access the service; reverse engineering, decompiling, or attempting to derive source code except where such restriction is prohibited by law; bypassing purchase or usage controls; and using the app for fraudulent, deceptive, abusive, harassing, defamatory, hateful, or otherwise harmful purposes.
You also may not use Sivibe to create or distribute content that invades privacy, exposes personal information without authorization, impersonates another person, promotes illegal activity, or violates platform rules or applicable law.
Sivibe is a lightweight lifestyle and meal-planning record tool designed to help users organize dining preferences and meal gathering notes for friends, family, or social groups. The service allows users to create and manage friend food profiles, record likes and dislikes, note allergy reminders and dietary restrictions, save common dishes, and keep personal notes for future gatherings.
The app also supports the creation of gathering records that may include date, time, meal type, location name, address notes, selected members, budget notes, desired dishes, special requests, photos, and optional voice notes. Based on user-entered information, Sivibe may display preference summaries, conflict reminders, dish suggestion records, order checklists, recent gathering memories, and a gathering timeline or archive for later review.
A distinguishing feature of the service is the shareable meal card, which compiles selected gathering details into an exportable visual card. Such cards may include time, gathering type, place, members, notes, and preference summaries, and may offer privacy controls that allow users to hide sensitive details such as allergy reminders, restriction notes, voice note references, or address details before export. The app may also offer visual card styles and image export functions for private sharing.
Sivibe is intended only for personal life organization and meal reference. It is not a restaurant reservation service, food delivery platform, public community, real-time collaboration service, advertising channel, or medical or nutrition advisory tool. New users may receive a limited number of free uses for selected premium actions. After free uses are exhausted, certain actions, such as generating a meal card or archiving gathering records, may require consumable coins purchased through Apple In-App Purchase. Viewing, editing, and deleting saved records may remain available without additional coin charges, as described in the app.
The app may request access to device features only when relevant to your chosen action, including camera access for capturing meal-related photos, photo library access for importing images, permission to save exported cards to your photo library, and microphone access for optional voice notes. User-entered preference data, gathering records, images, voice notes, and dish records are intended for personal recordkeeping and may be stored locally on the device, while purchase-related information may also be processed through Apple systems.
Subject to your compliance with these Terms, Sivibe grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, access, and use the app for your personal, non-commercial use only.
You may not rent, lease, sell, distribute, assign, or otherwise exploit the app except as expressly permitted by these Terms or applicable law.
Sivibe, including its software, design, layout, branding, interfaces, text, graphics, visual styles, compilations, and related intellectual property, is owned by or licensed to Sivibe and is protected by applicable intellectual property and proprietary rights laws.
Except for the limited license expressly granted in these Terms, no rights, title, or interest in the app or its intellectual property are transferred to you. You may not copy, modify, distribute, publicly display, create derivative works from, or otherwise use our protected materials without prior written permission.
You are solely responsible for the information, media, notes, labels, names, preferences, reminders, and other content you enter, record, import, export, or share through Sivibe. You represent that you have all necessary rights and permissions to use such content and that your use of the app does not violate privacy rights, intellectual property rights, contractual duties, or applicable law.
You are also responsible for reviewing what you choose to include in shareable meal cards or any exported content. If you record information about another person, including food preferences or allergy reminders, you are responsible for handling that information lawfully and appropriately.
You retain ownership of the content you submit or create in Sivibe, including text notes, friend preference details, gathering records, images, voice notes, and related materials. Sivibe does not claim ownership of your user content.
However, by using the service, you grant Sivibe a limited, non-exclusive, revocable license to host, process, format, display, reproduce, and use your content only as reasonably necessary to operate the app features you request, such as generating summaries, organizing meal records, exporting meal cards, displaying archives, or enabling local and platform-based functionality. This license ends to the extent your content is deleted from the app, subject to technical limitations, backup cycles, legal obligations, or platform requirements.
To the maximum extent permitted by law, Sivibe and its owners, operators, licensors, affiliates, contractors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, records, opportunities, or other intangible losses arising out of or related to your use of, or inability to use, the app.
This limitation applies whether the claim is based on warranty, contract, tort, negligence, strict liability, statute, or any other legal theory, even if we were advised of the possibility of such damages. To the extent liability cannot be excluded, our total liability shall be limited to the amount you paid, if any, to use Sivibe in the twelve months before the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless Sivibe and its owners, operators, affiliates, licensors, contractors, and service providers from and against any claims, demands, actions, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to: your use or misuse of the app; your user content; your violation of these Terms; your violation of any law or regulation; or your infringement or misappropriation of any third-party rights, including privacy, publicity, intellectual property, or other proprietary rights.
These Terms and any dispute, claim, or controversy arising out of or relating to Sivibe or these Terms shall be governed by and interpreted in accordance with applicable laws, without regard to conflict of law principles, except where mandatory consumer protection laws provide otherwise.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.

Sivibe may enable users to create, export, and share content derived from their meal gathering records, including cards, notes, images, voice notes, labels, and related social or person-based information. You are solely responsible for any content you post, share, export, transmit, or otherwise make available through the app. This includes ensuring that you have the right to share the content and that it does not violate privacy, publicity, intellectual property, or other legal rights.
You must not create, upload, post, transmit, or share content that is unlawful, threatening, abusive, harassing, hateful, discriminatory, defamatory, obscene, sexually exploitative, violent, misleading, fraudulent, invasive of privacy, or otherwise objectionable. Prohibited content also includes content involving minors in an inappropriate manner, personal data shared without authorization, impersonation, doxxing, malware, spam, scams, promotion of illegal goods or services, and any content that encourages self-harm, criminal acts, or dangerous conduct.
We reserve the right, but not the obligation, to review, restrict, remove, block, report, or preserve user content, and to suspend or terminate accounts or access where we believe content or behavior violates these Terms, applicable law, platform requirements, or the safety and integrity of the service. Moderation decisions may be made using manual review, automated tools, user reports, or a combination of these methods.
If you believe content or conduct on or through Sivibe violates these Terms or your rights, you may report it by contacting coldoveva12@icloud.com with sufficient detail for review. We may investigate and take action at our discretion, but we do not guarantee that every reported matter will result in removal or response within a specific timeframe.
